The information in this article is regularly checked against official sources from the Government of Andorra.<\/p>\n\n\n\n<p>Although Andorra is not a crypto paradise at least not yet, it is remarkable the <a href=\"https:\/\/andorrainsiders.com\/en\/andorra-tax-haven-banking-secret\/\" data-type=\"post\" data-id=\"1007\">the country's efforts to open up internationally and attract the most innovative sectors and markets<\/a> like Big Data or, in this case, blockchain. What <strong>Andorra is a jurisdiction that bets on cryptocurrencies and blockchain<\/strong>This is demonstrated by the fact that legislation has recently been passed to this effect: the <a href=\"https:\/\/www.afa.ad\/ca\/assets\/normativa\/llei-24-2022-del-30-de-juny-de-la-representacio-digital-d2019actius-mitjancant-l2019us-de-la-criptografia-i-de-la-tecnologia-de-llibre-registre-distribuit-i-blockchain\" target=\"_blank\" rel=\"noopener\">Law 24\/2022, of June 30, on the digital representation of assets through the use of cryptography and distributed ledger technology and Blockchain<\/a> that you can also read in the <a href=\"https:\/\/www.consellgeneral.ad\/ca\/activitat-parlamentaria\/lleis-aprovades\/llei-24-2022-del-30-de-juny-de-la-representacio-digital-dactius-mitjancant-lus-de-la-criptografia-i-de-la-tecnologia-de-llibre-registre-distribuit-i-blockchain\" target=\"_blank\" rel=\"noopener\">General Council page<\/a>.<\/p>\n\n\n\n<p><strong>This legislation, as its name indicates, seeks to give legal validity to the issuance of cryptocurrencies and other cryptoactives by private parties.<\/strong> (individuals and companies) and follow the <a href=\"https:\/\/www.consellgeneral.ad\/fitxers\/documents\/lleis-2021\/llei-9-2021-del-29-d2019abril-de-modificacio-de-la-llei-35-2014-del-27-de-novembre-de-serveis-de-confianca-electronica\/view\" target=\"_blank\" rel=\"noopener\">Law 9\/2021, of April 29, amending Law 35\/2014, of November 27, on electronic trust services<\/a> whereby it was determined that <strong>Blockchain technology is an electronic trust service at the legal level<\/strong>. Well, in this article we will address the situation and the advantages of doing a business in this sector in the Principality. Of course, the main and most obvious advantage is tax, but it is not the only one.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cryptocurrency environment in Andorra in 2025-2026<\/h2>\n\n\n\n<p><strong>2022 has not been a good year for cryptocurrencies<\/strong>. After a few years of economic bonanza due to unprecedented monetary expansion by the Fed, recession drums are beating. Central banks are raising interest rates at the fastest pace in history to alleviate the <a href=\"https:\/\/andorrainsiders.com\/en\/andorra-inflation-rate-charts-index\/\" data-type=\"post\" data-id=\"6455\">inflation<\/a> And financial capital fled from Bitcoin, which reached a price of around $15,000-$20,000 at the end of 2022. <strong>Since then the market has recovered strongly<\/strong>In April 2026, Bitcoin is trading around $75,000, driven by institutional demand and the approval of spot ETFs in the US and Andorra.<\/p>\n\n\n\n<p><strong>However, the crypto winter also brings good news<\/strong>. First, since some crypto assets are supposed to function as safe havens, they are expected to perform very well in economic downturns. If that were so, <strong>cryptocurrencies would be trading at a discount right now<\/strong>. Good investors buy at a discount. But not only that: <strong>winter is sowing time, also for the crypto sector<\/strong>. Now it is time to develop projects so that they bear fruit in the coming years.<\/p>\n\n\n\n<p><strong>The profiles of Bitcoin traders, investors and hodlers and in general cryptocurrency projects that transfer their business to the Principality of Andorra have been protagonists in the year 2021<\/strong>, a year already marked by a strong boom and a maximum of new residents due to the pandemic and its poor management, by <a href=\"https:\/\/andorrainsiders.com\/en\/teleworking-working-from-home-andorra\/\" data-type=\"post\" data-id=\"3892\">telecommuting<\/a> Yet the <a class=\"rank-math-link\" href=\"https:\/\/andorrainsiders.com\/en\/rubius-moves-to-andorra-with-another-youtuber\/\">trend set by El Rubius<\/a>. Specifically, the most innovative project was that of the<strong> video games with cryptocurrencies<\/strong>, numerous in Andorra and practically all established during 2021.<\/p>\n\n\n\n<p>All those businesses are right now in development, waiting for the next crypto boom to launch and grow. Well, today we are going to see clearly the treatment of cryptocurrencies in Andorra and its <a href=\"https:\/\/andorrainsiders.com\/en\/advantages-of-andorra\/\" data-type=\"page\" data-id=\"544\">advantage<\/a> beyond taxation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The importance of fund traceability<\/h2>\n\n\n\n<p>However, from Andorra Insiders we must insist that <strong>the source of funds must be clear<\/strong> when someone who owns these crypto assets wants to settle in some currency, especially if the objective is to operate with said funds again through the banking system and acquire goods and services with them. Maintaining the traceability of operations is essential to be able to declare cryptocurrencies.<\/p>\n\n\n\n<p>Specifically speaking of the Principality, we already reflected in other articles <a href=\"https:\/\/andorrainsiders.com\/en\/andorra-banks\/\" class=\"rank-math-link\">how meticulous and strict Andorran banks are<\/a>. This has always happened because the Andorran banks have investments of great wealth and businesses from all over the world, and <strong>their prestige is highly valued<\/strong>, image and brand for investors of all kinds as a serious, respectable and responsible bank.<\/p>\n\n\n\n<p>Therefore the banks <strong>they are always cautious and put problems in all activities considered morally doubtful (for them)<\/strong>: from online games, casinos and others related to gambling, to adult themes and pornography, through tarot and fortune telling businesses. In addition and as we also commented, after the BPA crisis that led to the transformation of the country, these controls have been intensified.<\/p>\n\n\n\n<p>The case of cryptocurrencies is therefore not an exception, quite the opposite. Due to their properties and anonymity and how new they are,<strong> these assets are highly susceptible to money laundering<\/strong> and therefore for banks to accept the income and cash flows generated with them, it must always be proven that the ultimate origin of the funds resides in an entity of the banking system or that <strong>somehow the completely legal origin can be certified<\/strong> thereof.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Intermediate operations are also taxed<\/h2>\n\n\n\n<p>The cryptocurrency exchange per se <strong>generates a taxable income that must be declared in personal income tax<\/strong>, regardless of whether whoever transmits the cryptocurrency obtains a legal tender currency (fiat), another cryptocurrency or another type of asset. That is to say: that when someone sells for example bitcoin, even if they obtain another cryptocurrency such as Ethereum, that operation per se is already subject to tax and constitutes a capital gain or loss that must be declared.<\/p>\n\n\n\n<p>This fiscal impact, for many still unknown, <strong>has been clearly exposed by the tax authorities of practically all of Europe<\/strong>, including Andorra. In fact, in Spain, the verification of all operations, which includes the exchange of information with other jurisdictions such as Malta and Estonia, are part of the tax control plan for this year, and therefore, <strong>it is foreseeable that tax inspections will intensify in the sector<\/strong>.<\/p>\n\n\n\n<p>The operation is therefore relatively simple and works like this both in Andorra <a href=\"https:\/\/andorrainsiders.com\/en\/cryptocurrency-taxes-spain-europe\/\" data-type=\"post\" data-id=\"4141\">as in most countries of the world including Spain<\/a>: <strong>each time a certain amount of cryptocurrencies, tokens or crypto assets is liquidated or sold, the holder of them obtains a capital gain \/ loss<\/strong> calculated as the value of the crypto in the sale operation minus the value in the purchase. In the case of Andorra, cryptocurrencies are currently considered one more asset, and therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li> The operations of natural persons are taxed by the personal income tax savings base as capital gains. which supposes a <strong>10% on net profit with \u20ac 3,000 exempt income<\/strong>.<\/li><li>as society <a class=\"rank-math-link\" href=\"https:\/\/andorrainsiders.com\/en\/corporation-tax-is-andorra\/\">The corporate tax in Andorra is 10%<\/a> and therefore they are taxed at this type but deducting expenses. Also, dividends from Andorran companies are not taxed by personal income tax, so that&#039;s it.<\/li><\/ul>\n\n\n\n<p>Thus, the profits obtained from cryptocurrency trading in Spain are subject to personal income tax at a rate between 19% and 26% and by corporate tax at 25% (plus personal income tax), while <strong>the maximum rate applicable in Andorra is 10%<\/strong>. Less than half minimum, certainly a significant savings.\u00a0<a class=\"rank-math-link\" href=\"https:\/\/andorrainsiders.com\/en\/impuestos-tasas-tributos\/\">You can read about Andorran taxes in greater depth here<\/a>.<\/p>\n\n\n\n<p>The main difference however is that <strong>In jurisdictions such as Spain, the cryptocurrency must be declared in the Wealth Tax<\/strong>, that is, it is taxed for the simple fact of owning cryptocurrencies in one&#039;s own patrimony. <strong>In Andorra there is no wealth tax<\/strong>, nor on inheritance and donations, with which the mere possession of these crypto assets is exempt from tax.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Crypto platforms used<\/h2>\n\n\n\n<p>The most famous exchange used in Andorra is <strong>Binance, although Coinbase is also very established<\/strong>. There are also the banks taking over Kraken. In general, we recommend that you verify that the platform on which you operate allows Andorra as the country of residence of the account and that it is a reliable, secure platform whose traceability of funds is clear. In general, it must be a platform with a reputation and that provides confidence to Andorran banks in such a way that they understand that there is no possibility of carrying out money laundering or other types of fraud with them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Andorra&#039;s blockchain legislation<\/h2>\n\n\n\n<p>Due to the covid-19 crisis, Andorra prepared a <strong>package of measures or plan for 2023<\/strong> called &quot;Horitz\u00f3 23&quot; with which it intends to face the dire consequences that this pandemic has caused, especially as regards the economic ones. One of the 77 initiatives of the plan is the modification of the <a class=\"rank-math-link\" href=\"https:\/\/www.consellgeneral.ad\/fitxers\/documents\/lleis-2014\/llei-35-2014-del-27-de-novembre-de-serveis-de-confianca-electronica\/view\" target=\"_blank\" rel=\"noopener\">Law 35\/2014, on electronic trust services<\/a> to include in these all systems <em>blockchain<\/em>.<\/p>\n\n\n\n<p>This law was passed in 2014 and <strong>seeks to regulate those electronic services that require trust<\/strong>namely: electronic signatures and seals, certificates of authentication, and electronic delivery services and time stamps. Thus, the modification of the law would give all cryptocurrencies and other blockchain-based technologies the legal value of being reliable and usable.<\/p>\n\n\n\n<p>Finally, <strong>the initiative ended up establishing a modification<\/strong> with the already approved <a href=\"https:\/\/www.consellgeneral.ad\/ca\/activitat-parlamentaria\/lleis-aprovades\/llei-9-2021-del-29-d2019abril-de-modificacio-de-la-llei-35-2014-del-27-de-novembre-de-serveis-de-confianca-electronica\" target=\"_blank\" rel=\"noopener\">Law 9\/2021 of April 29, modification of Law 35\/2014, of November 27, on electronic trust services<\/a>, a law that grants legal validity to blockchain assets and evidence as legal acts, such as electronic trust services and also lays the foundations for <strong>address the different options in reference to taking advantage of opportunities in the field of Blockchain<\/strong>.<\/p>\n\n\n\n<p>On the other hand, the <a href=\"https:\/\/www.consellgeneral.ad\/ca\/arxiu\/arxiu-de-lleis-i-textos-aprovats-en-legislatures-anteriors\/vi-legislatura-2011-2015\/copy_of_lleis-aprovades\/llei-20-2014-del-16-d2019octubre-reguladora-de-la-contractacio-electronica-i-dels-operadors-que-desenvolupen-la-seva-activitat-economica-en-un-espai-digital\" target=\"_blank\" rel=\"noopener\">Law 20\/2014 of October 26 regulating electronic contracting and operators that carry out their economic activity in a digital space<\/a> is legislation in which, due to its characteristics, it is already implemented <strong>certain legal treatment regarding smart contracts in Andorra<\/strong>. Thus, Andorra already had a basic advantage towards Europe, since here certain legislative texts have already been approved and Europe, which is following the same line, will take at least two years to have all this regulation approved.<\/p>\n\n\n\n<p>The previous legislative modification has borne fruit in the <a href=\"https:\/\/www.afa.ad\/ca\/assets\/normativa\/llei-24-2022-del-30-de-juny-de-la-representacio-digital-d2019actius-mitjancant-l2019us-de-la-criptografia-i-de-la-tecnologia-de-llibre-registre-distribuit-i-blockchain\" target=\"_blank\" rel=\"noopener\">Law 24\/2022, of June 30, on the digital representation of assets through the use of cryptography and distributed ledger technology and Blockchain<\/a>, published in the <a href=\"https:\/\/www.afa.ad\/ca\/assets\/normativa\/llei-24-2022-del-30-de-juny-de-la-representacio-digital-d2019actius-mitjancant-l2019us-de-la-criptografia-i-de-la-tecnologia-de-llibre-registre-distribuit-i-blockchain\/cgl20220715_13_23_43.pdf\" target=\"_blank\" rel=\"noopener\">BOPA<\/a> and referenced both on the AFA page and on that of the General Council. A <strong>law that regulates professional activities in the field of blockchain carried out from Andorra<\/strong>, despite having been cut by the legislator. This law was drafted by Nacho Alamillo Domingo, a legal expert in the European Blockchain Services Infrastructure project of the European Commission and who is also contributing to European regulation.<\/p>\n\n\n\n<p>The idea is to provide a <strong>minimum basis<\/strong> to regulate, organize and supervise business practices using this technology, while opening the door for the development of more ambitious laws on the application of blockchain in the Principality in the future. Specifically, <strong>applies to tokenization practices<\/strong> (digital representation of assets) carried out by private Andorran companies, which must be authorized by the AFA in order to operate. Something similar to what happens with <a href=\"https:\/\/andorrainsiders.com\/en\/stockbroker-trader-financial-analyst\/\">brokers, investment funds and financial advisers<\/a>.<\/p>\n\n\n\n<p><strong>The AFA will be in charge of the strict authorization, registration, supervision and control process<\/strong> for individuals and companies that carry out activities of issuance and custody of tokens, create platforms for the sale of tokens or are digital veedor, etc. that they will have to meet very high standards of experience, solvency and professionalism to be able to operate in the Andorran market. The objective is <strong>ensure that blockchain technology is put to good use<\/strong> and that the interests of participating users are protected.<\/p>\n\n\n\n<p>However, <strong>important procedures to be regulated in the future will be outlawed<\/strong>, such as the issuance of assets that are considered financial instruments or electronic money, that is, that can be a substitute for money and allow payments to be made through virtual currencies. At the moment they are not foreseen, but the Government must regulate them within a maximum period of twelve months from the entry into force of the law.<\/p>\n\n\n\n<p><strong>The figure of the digital veedor stands out in the Law, which will be the body in charge of guaranteeing that the projects comply with<\/strong> with the requirements of the law. The digital observer must necessarily be a lawyer or economist registered in Andorra and have Andorran nationality or fiscal residence. And any entity that wants to operate in Andorra must necessarily designate a digital veedor accredited by the AFA. <a href=\"https:\/\/www.govern.ad\/finances\/item\/15042-s-aprova-el-reglament-de-desenvolupament-dels-requisits-per-exercir-com-a-veedor-digital-les-seves-obligacions-i-el-regim-disciplinari-i-sancionador\" target=\"_blank\" rel=\"noopener\">The figure of the veedor already has its own approved regulation<\/a> that defines its requirements, obligations, etc.<\/p>\n\n\n\n<p>in an innovative way <strong>smart contracts are also regulated<\/strong>, which are those that are prepared automatically within the blockchain software without the manual intervention of a lawyer or other professional. These will be legally valid in Andorra if certain requirements are met, such as that they are immutable, that they are digitally signed and that the object of the transaction can be verified and controlled.<\/p>\n\n\n\n<p>However, the implications of these laws <strong>they go far beyond cryptocurrencies, since it implies admitting the value of distributed consensus that technology itself manages to make a reality<\/strong>If this trend continues, we could be talking in a few years about giving legal validity\u2014notarized and contractual, for registration and exchange, etc.\u2014to all tools that use blockchain, and even being able to issue cryptocurrencies. In the European context, the <strong>MiCA Regulation (EU 2023\/1114)<\/strong> It is fully applicable from December 30, 2024, in the 27 EU member states. Andorra, not being an EU member, is not directly subject to MiCA, although the EU-Andorra Association Agreement (negotiations concluded in 2023, pending ratification) could require a progressive alignment of Andorran regulations with European regulations on crypto assets.<\/p>\n\n\n\n<p>The framework was completed with the approval of the <a href=\"https:\/\/www.consellgeneral.ad\/ca\/activitat-parlamentaria\/lleis-aprovades\/llei-42-2022-de-l20191-de-desembre-de-l2019economia-digital-l2019emprenedoria-i-innovacio\" target=\"_blank\" rel=\"noopener\"><strong>Law 42\/2022, of December 1, on the digital economy, entrepreneurship and innovation<\/strong><\/a>Published in the BOPA on December 22, 2022, this law specifically regulates entrepreneurship visas, the fintech sandbox, digital nomads, teleworking, and special economic zones. Its implementing regulations were approved by Decree 212\/2023, of May 10, 2023.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mining and blockchain business in Andorra<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img decoding=\"async\" width=\"640\" height=\"360\" src=\"https:\/\/andorrainsiders.com\/wp-content\/uploads\/2022\/03\/mining-andorra.jpg\" alt=\"Mining or mining of cryptocurrencies in Andorra and other businesses with blockchain\" class=\"wp-image-5720\" srcset=\"https:\/\/andorrainsiders.com\/wp-content\/uploads\/2022\/03\/mining-andorra.jpg 640w, https:\/\/andorrainsiders.com\/wp-content\/uploads\/2022\/03\/mining-andorra-300x169.jpg 300w, https:\/\/andorrainsiders.com\/wp-content\/uploads\/2022\/03\/mining-andorra-18x10.jpg 18w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n<\/div>\n\n\n<p>Other activities related to cryptocurrencies such as <strong>cryptocurrency mining or other businesses related to the blockchain have also arrived in Andorra<\/strong>. The type of residence that this type of profile usually takes advantage of is the <a class=\"rank-math-link\" href=\"https:\/\/andorrainsiders.com\/en\/residency-immigration-living\/\">self-employment<\/a>, by means of the <a class=\"rank-math-link\" href=\"https:\/\/andorrainsiders.com\/en\/open-and-set-up-a-business-in-andorra\/\">creation of a society<\/a> to develop your activity. The taxation of the company, as in the case of a natural person, is the <strong>10% on the profit obtained<\/strong> in society.
